1. Agreement to Terms
These Terms and Conditions ("Terms") are a legally binding agreement between you ("User," "you," or "your") and Nitin Mathuria, trading as Zylos Os ("we," "us," or "our") regarding your use of the Zylos Launcher Android application ("App").
By downloading, installing, or using the App, you confirm that:
- You are at least 13 years old (or 16 years old in the EEA/UK)
- If you are between 13 and 18, a parent or legal guardian has reviewed and agreed on your behalf
- You have read, understood, and agree to be bound by these Terms and our Privacy Policy
- You have the legal capacity to enter into a binding agreement (Indian Contract Act, 1872)
If you do not agree, stop using the App and uninstall it.

Governing law: These Terms are governed by the laws of the Republic of India. Subject to Section 13, courts of Jaipur, Rajasthan, India have exclusive jurisdiction.
3. Electronic Communications Consent (E-SIGN)
By using the App, you consent to receive communications from us electronically (in-app and email). This satisfies the U.S. E-SIGN Act (15 U.S.C. § 7001) and similar laws where applicable.
4. Description of the App
Zylos Launcher is an Android home screen launcher providing:
- Customizable home screen, app drawer, folders, and drag-and-drop layout
- Feed cards (calendar, contacts, music, screen time) — all processed locally
- Gesture controls and system navigation shortcuts
- Video and static wallpaper support
- App update checking via our servers
- Support for hosting third-party Android widgets
- Material You theming and customization
5. License to Use the App
5.1 Grant
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on Android devices you own or control, for personal, non-commercial use only.
5.2 Restrictions
You may not:
- Copy, modify, distribute, sell, or sublicense any part of the App
- Reverse-engineer, decompile, or disassemble the App, except as required by applicable law
- Use the App to build a competing product or service
- Remove or alter any proprietary notices or labels
- Use automated tools (bots, scrapers) to access the App or its services
- Use the App for any unlawful, harmful, or abusive purpose
5.3 Updates
We may issue updates that modify or remove features. Continued use after an update constitutes acceptance.
6. Sensitive Device Permissions
By granting the following optional permissions, you acknowledge:
- Notification Access: Read only to display content on your home screen. Never stored or transmitted. Revoke anytime in Android Settings.
- Accessibility Service: Used only for gesture controls within the launcher. Does not read content from other apps or log input. Revoke anytime in Android Settings.
- Contacts: Accessed only for quick-action shortcuts on the feed. Never uploaded or shared.
- Calendar: Accessed only to display events in the feed card. Never uploaded or shared.
- App Usage Stats: Used only for your personal screen time display. Never uploaded or shared.
- Media (Images/Video): Accessed only for wallpaper selection. Never uploaded or shared.
- Internet (INTERNET): Used for checking app updates (minimal metadata only), Firebase Analytics, and Firebase Crashlytics. No personal data is transmitted during update checks.
These permissions are optional. Revoking them disables the associated feature but does not affect core launcher functionality.
7. Third-Party Widgets and Services
7.1 Third-Party Widgets
Zylos Launcher hosts widgets from third-party apps on your device. These are operated entirely by their respective developers. We have no control over and are not responsible for their content, data practices, or terms. Use of third-party widgets is at your own risk.
7.2 External Links
The App may contain links to external websites. We are not responsible for their content or privacy practices.
8. Intellectual Property
8.1 Our Property
The App, its code, design, UI, logos, and trademarks ("Zylos," "Zylos Launcher," "Zylos Os") are owned by or licensed to us and protected by applicable intellectual property laws. These Terms do not transfer any ownership to you.
8.2 Copyright Complaints (DMCA)

Notices must comply with 17 U.S.C. § 512(c)(3).
8.3 Feedback
If you provide suggestions or feedback, you grant us an irrevocable, perpetual, royalty-free license to use it without obligation to you.
9. Disclaimers and No Warranties
Jurisdiction-specific notes:
- Australia/New Zealand: Nothing herein excludes rights under the Australian Consumer Law or NZ Consumer Guarantees Act that cannot be excluded.
- EU/UK consumers: Statutory consumer rights under EU/UK law are unaffected.
- California: Nothing limits rights under the CLRA or UCL that cannot be waived.
10. Limitation of Liability
Jurisdiction-specific notes:
- New Jersey: Consequential damage limitations may not apply to NJ consumers.
- EU/UK: These limitations do not apply to liability that cannot be limited under EU/UK consumer law.
- Australia: Liability for breach of consumer guarantees is limited to re-supplying the service.
11. Indemnification
You agree to defend, indemnify, and hold harmless Zylos Os and its officers from claims arising from your violation of these Terms, your use of the App in violation of applicable law, or any third-party claim arising from your actions through the App.
12. Jurisdiction-Specific Provisions
12.1 California
CLRA: Provide 30 days' written notice to support@zylosos.com before filing any CLRA action.

Shine the Light / Minor removal: Contact support@zylosos.com.
12.2 Texas
DTPA: Provide 60 days' written notice to support@zylosos.com before filing a DTPA lawsuit.
12.3 New York
Nothing limits rights under GBL §§ 349 or 350.
12.4 Florida
Nothing limits rights under FDUTPA (Fla. Stat. § 501.201 et seq.).
12.5 Illinois
The App does not collect biometric identifiers or information as defined by BIPA (740 ILCS 14).
12.6 Virginia / Colorado / Connecticut
We do not sell personal data or use it for targeted advertising. See Privacy Policy.
12.7 Washington
The App does not collect consumer health data under the Washington My Health MY Data Act.
12.8 New Jersey
Section 10's liability limitation does not apply to NJ Consumer Fraud Act claims.
12.9 Massachusetts
Chapter 93A: Provide 30 days' written notice to support@zylosos.com before filing.
12.10 EU / UK
EU/UK consumers retain the right to bring claims before local courts and may use the EU ODR platform at https://ec.europa.eu/consumers/odr. Mandatory consumer rights under EU/UK law are unaffected.
12.11 Canada
We comply with PIPEDA and applicable provincial privacy legislation. Quebec residents may contact us under Law 25 at support@zylosos.com.
12.12 Australia and New Zealand
Nothing excludes rights under the Australian Consumer Law or NZ Consumer Guarantees Act 1993.
12.13 Brazil — LGPD
Contact support@zylosos.com or the Brazilian Data Protection Authority (ANPD).
12.14 India — Operator Jurisdiction
IT Act, 2000 & IT (Amendment) Act, 2008: We comply with Section 43A and the IT (Reasonable Security Practices) Rules, 2011.

12.15 Other Jurisdictions
We comply with applicable consumer protection laws in all jurisdictions. These Terms do not override mandatory statutory rights that cannot be waived by contract.
13. Dispute Resolution and Arbitration
13.1 Informal Resolution First
Contact support@zylosos.com with a written description of your claim. We will attempt to resolve it within 30 days before any formal proceedings.
13.2 Binding Individual Arbitration (US Users)
For US users, all disputes shall be resolved by binding individual arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs. For claims under $10,000, we pay all AAA fees unless the arbitrator finds the claim frivolous.
13.3 Class Action and Jury Trial Waiver (US Users)
13.4 Opt-Out
Opt out within 30 days of first accepting these Terms by emailing support@zylosos.com with subject "Arbitration Opt-Out."
13.5 Small Claims Exception
Either party may bring individual claims in small claims court if eligible, or seek emergency injunctive relief in court.
13.6 Non-US Users
Disputes shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (India), with the seat of arbitration in Jaipur, Rajasthan, India, in English. EU/UK consumers may bring claims before local courts per Section 12.10.
13.7 Time Limit
14. Termination
We may suspend or terminate your access for breach of these Terms, illegal conduct, or discontinuation of the App. Upon termination your license ends immediately. Sections 8, 9, 10, 11, 12, and 13 survive termination.
15. Export Controls
You may not use the App in violation of U.S. export laws or in countries subject to U.S. government embargo.
16. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control.
17. General Provisions
- Severability: Invalid provisions are modified to the minimum extent necessary; remaining provisions continue in full force.
- Waiver: Failure to enforce a provision is not a waiver.
- Assignment: You may not assign these Terms. We may assign freely.
- Entire Agreement: These Terms and the Privacy Policy are the entire agreement between us.
- Language: English controls in case of translation conflict.
18. Future Features Notice
A future version will introduce user accounts, a theme marketplace, and in-app purchases. We will update these Terms before those features launch and notify you in-app at least 15 days in advance.
19. Changes to These Terms
We will update the "Last updated" date and notify you via in-app notification. Continued use after the notice period constitutes acceptance. For changes to Section 13 (arbitration), you have 30 days to opt out by contacting support@zylosos.com.
